The firm also has extensive experience with the complexities of litigating actions pursuant to the federal Racketeer Influenced and Corrupt Organizations Act (RICO) and its numerous state law counterparts. By bringing RICO claims, when appropriate, plaintiffs are able to seek and potentially recover triple damages.

For example, the firm joined other prominent class action attorneys to litigate Antitrust and RICO claims against certain brokers and insurance companies based on allegations that they had engaged in such practices as bid-rigging and market allocation through the abusive use of contingent commissions. As a result of this litigation, Drubner & Hartley was among a number of firms that successfully obtained court approval for a $121 million settlement with Zurich Insurance and a $28 million settlement with Arthur J. Gallagher & Co.

Drubner & Hartley have been designated co-lead counsel in Waterbury Hospital et al. v. U.S. Foodservice, case involving RICO claims. Filed on behalf of the firm’s client, Waterbury Hospital, and others, the complaint details an alleged illegal kickback scheme that artificially inflated the prices that the hospital and other clients paid for the food that they purchased from U.S. Foodservice.
